This Privacy Policy does not apply to the practices of third parties that GoEngineer does not own or control, or to individuals that GoEngineer does not employ or manage.
This Privacy Policy also does not apply to information that we receive or handle on behalf of our subscribers in our role as a service provider, such as information that we receive through the GoEngineer Marketing Automation Software Services or other GoEngineer services, including any apps we make available for use by Services subscribers (collectively, the “ Services ”). Such information is governed by the terms of the applicable services agreement, rather than this Privacy Policy.

We may also provide your Personal Information to agents and service providers to verify or compile aggregate usage data that we provide to our partners. GoEngineer Blog and Social Media Pages:
Personal Information may also be disclosed by you through the Sites, on message boards, chat, profile pages and blogs and other services to which you are able to post information and materials (including, without limitation, our GoEngineer Blog, at https://www.goengineer.com/blog and the Social Media Pages). This information may appear in public ways, such as through search engines or other publicly available platforms, and may be “crawled” or searched by third parties. Please do not post any information that you do not want to reveal to the public at large.
Business Transfers:
In some cases, we may buy or sell assets or businesses. In these types of transactions, user information is typically one of the business assets that is transferred. GoEngineer may disclose Personal Information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).
Protection of GoEngineer and Others:
We may release Personal Information when we believe that release is necessary or appropriate (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities including public and government authorities outside your country of residence; (d) to enforce or apply our conditions of use and other agreements; (e) to protect our operations or those of any of our Affiliates; (f) to allow us to pursue available remedies or limit the damages that we may sustain; and (g) to protect the rights, privacy, property, or safety of GoEngineer, our employees, our Affiliates, our users, or any other person or entity. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
5. How Does GoEngineer Use and Disclose Other Information?
We may use and disclose Other Information for any purpose, except where we are required to do otherwise under applicable law. If we are required to treat Other Information as Personal Information under applicable law, then we may use it for all the purposes for which we use and disclose Personal Information.
In some instances, we may combine Other Information with Personal Information (such as combining your name with your geographical location). If we do, we will treat the combined information as Personal Information for as long as it is combined.
6. How Does GoEngineer Secure Personal Information About Me?
We have implemented organizational, technical, and administrative measures to protect Personal Information within our organization, including security controls to prevent unauthorized access to our systems. While we take reasonable steps to secure your Personal Information from loss, misuse, interference and unauthorized access, modification and disclosure, you should be aware no security procedures or protocols are ever guaranteed to be 100 percent secure from intrusion or hacking, and there is therefore always some risk assumed by sharing Personal Information online. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please immediately notify us in accordance with the “ Questions, Concerns and Complaints ” section below.
7. How Can I Access, Correct, Amend or Remove Information About Me?
If you would like to access, correct, amend, remove or limit the use or disclosure of any Personal Information about you that has been collected and stored by GoEngineer, please notify us at privacyofficer@GoEngineer.com so that we may consider and respond to your request in accordance with applicable law.
For your protection, we may only implement requests with respect to the Personal Information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will respond to your request within 45 days.
Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting such access, change or deletion.
8. For How Long Will GoEngineer Retain My Personal Information?
We will retain your Personal Information for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.

You can always opt not to disclose information. However, if you elect to do so, we may be limited in responding to your inquiry or providing services to you.

10. Can Children Use GoEngineer's Sites?
The Sites are not intended for minors under the age of 18. GoEngineer does not knowingly or specifically collect information about minors under the age of 18 and believes that children of any age should get their parents’ or legal guardians’ consent before providing any Personal Information. If you believe that we have mistakenly or unintentionally collected such information, please notify us at privacyofficer@GoEngineer.com so that we may delete the information from our servers.

The Sites may permit you to link to other websites on the Internet through direct links or through applications such as “share” or “Like” buttons, and other websites likewise may contain links to the Sites. The information practices or content of such other websites is governed by the privacy statements of those websites and not by this Privacy Policy. We encourage you to review the privacy policies found on such other websites, services, and applications to understand how your information may be collected and used.
Similarly, please note that we are not responsible for the collection, use and disclosure policies and practices (including the data security practices) of other organizations, such as Facebook, Apple, Google, Microsoft, RIM, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including any Personal Information you disclose to other organizations through or in connection with the Apps or the Social Media Pages.

We ask that you not send us or disclose any sensitive Personal Information ( e.g. , social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership) on or through the Sites or via other means.
13. Changes to this Privacy Policy
GoEngineer may amend this Privacy Policy from time to time. The “ Effective Date ” legend at the top of this page indicates when this Privacy Policy was last revised. Any changes to this Privacy Policy will become effective when we post the revised Privacy Policy on the Sites. Your use of the Sites following these changes means that you accept the revised Privacy Policy.
14. Privacy Shield Certification
GoEngineer complies with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of Personal Information from European Union member countries and Switzerland to the United States, respectively. GoEngineer has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of notice, choice, accountability for onward transfer, security, data integrity and purpose limitation, access, and recourse, enforcement and liability. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern.

Collection of general information when visiting our website
Nature and purpose of the processing:
When you access our website, i.e., when you do not register or otherwise submit information, information of a general nature is automatically collected. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider, your IP address and the like.

Storage Duration:
The data is deleted as soon as it is no longer required for the purpose for which it was collected. This is generally the case for data used to provide the website when the respective session has ended.
In the case of storage of data in log files, deletion takes place after 14 days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are anonymized, so that an assignment of the calling client is no longer possible.

The provision of the aforementioned personal data is neither legally nor contractually required. However, without the IP address, the service and functionality of our website is not guaranteed. In addition, individual services and services may not be available or may be limited.

EU-U.S. DPF Principles and Swiss-U.S. DPF Principles
GoEngineer is aware that the European Court of Justice declared the EU-U.S. DPF Principles as invalid in its ruling from 16 July 2020. Consequently, the EU-U.S. DPF Principles is no longer a valid mechanism for the transfer of personal data from European Economic Area (EEA) to the United States of America. GoEngineer is also aware that the Swiss Federal Data Protection and Information Commissioner on 08 September 2020 declared that the Swiss-U.S. DPF Principles does not provide an adequate level of protection for the transfer of personal data from Switzerland to the US.
However, in accordance with the relevant advice and request by the US Federal Trade Commission (FTC), GoEngineer continues to comply with the EU-U.S. DPF Principles and Swiss-U.S. DPF Principles as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the EEA and Switzerland to the United States. GoEngineer complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. GoEngineer has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union and the United Kingdom in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF. GoEngineer has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. GoEngineer would oppose and aggressively defend against government law enforcement requests to disclose any personal data collected on this website. To the extent possible, GoEngineer will without undue delay inform the affected data subject about such government law enforcement requests and support the data subject in defending its rights under the GDPR. GoEngineer concludes Standard Data Protection Clauses (also known as Standard Contractual Clauses) with all data processors outside the EU/EEA. In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, GoEngineer commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to TRUSTe’s IRM, an alternative dispute resolution provider based in the United States. If you do not receive timely acknowledgment of your DPF Principles-related complaint from us, or if we have not addressed your DPF Principles-related complaint to your satisfaction, please visit https://feedback-form.truste.com/watchdog/requestfor more information or to file a complaint. 2.4 Consumer Rights Under the CCPA
Your rights under the CCPA include the right to request a copy of the specific personal information collected about you in the 12 months prior to the request, and a business’s data collection practices (including categories of information collected, how information is used, and who it is disclosed to). We will generally refer to these as “access requests”.
In addition, with some exceptions, you can request deletion of the personal information that is collected about you. We will generally refer to these as “deletion requests”.

With respect to personal data of consumers collected in GoEngineer products and services, GoEngineer’s clients are responsible for fulfilling access and deletion requests. GoEngineer supports these requests by offering our clients product features, processes and assistance in exporting personal information about individuals. These product features and processes complete the data deletion within 30 days of receiving the request from our client.
With respect to the personal data of consumers collected in GoEngineer’s marketing and recruiting efforts, we are responsible for fulfilling access and deletion requests.
